PO Box 9800 Amarillo Texas 79105-9800 (“Sponsor”) The Contest Administrator is Backpackercom (“Administrator”) 2 CONTEST DESCRIPTION: The Merrick Pet Care “BACKPACKING WITH BACKCOUNTRY” Contest (the “Contest”) is a contest conducted on the Backpackercom Website at wwwbackpackercom (the “Site”) in order to select the winner Persons who submit entries to the Contest that meet the eligibility requirements below are referred to herein as “Contestants” The Contest gives Contestants an opportunity to share their dogs out on an outdoor adventure There will be one (1) Grand Prize Winner 3 CONTEST PERIOD: The Contest begins at 12:01 AM Eastern Time (ET) on July 6 2015 and ends 11:59 PM ET on August 31 2015 (the “Contest Period”) The computer and website of Sponsor (defined below) is the official time and record keeping device of the Contest The winners will be announced the week of September 21 2015 4 ELIGIBILITY: Contest is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least twenty-one (21) years of age or older at time of entry and who meet all other requirements herein Void where prohibited or restricted by law Limit one (1) winner per household Employees of Sponsor including individuals who have previously been employed by Sponsor at any time within the past twelve (12) months or any of Sponsor’s parent companies subsidiaries affiliates divisions licensors licensees advertising and promotion fulfillment and related entities and prize suppliers (collectively “Contest Entities”) and their immediate families and/or those living in the same household are not eligible to enter or win For purposes of this Contest “immediate families” are defined as spouses parents step-parents children step-children siblings step-siblings grandparents and their respective spouses regardless of where they reside 5 HOW TO ENTER: Contestants must (i) go to the Site; (ii) and upload at least one (1) photo of their pet to the Site according to the specifications below There is no daily or overall limit on the number of entries per Contestant during the Contest Period 6 PHOTO SPECIFICATIONS: All photo submissions should be in a JPEG or PDF file format with a maximum 3 megabytes The photos that you upload must be your sole creative work and must not incorporate ideas or work of any other person or material that would require the consent of a third party in any jurisdiction The photos must include only your pet you and/or the pet’s parent/owner and no other subjects Without limitation the photos must not infringe or violate any trademark copyright publicity right privacy or any other right of any other person or entity under any applicable law By submitting an entry you represent and warrant to Sponsor that the entry and everything depicted in the photos are wholly original and do not infringe upon or otherwise violate any right of any person entity or any law rule or regulation Violation or breach of these representations or warranties may void your entry in Sponsor’s sole discretion and subject you to penalties and damages under applicable law By entering the Contest you agree that Sponsor may post your photo image likeness copy or any part thereof on the Site on Sponsor’s website in its retail stores or any other promotional or media outlets Sponsor does not guarantee the posting of any photo You understand that your name and biographical data (as entered on the entry form) may also be posted on the Site in its retail stores or any other promotional or media outlets in connection with the Contest and used by Sponsor or any of its affiliates for the purpose of demographic studies marketing research third party vendor product and service development contact information and promotions 7 PHOTO RESTRICTIONS: No entry whether a photo may contain as determined by Sponsor in its sole discretion any content that: • Is sexually explicit obscene suggestive pornographic or contains nudity; • Is violent or derogatory of any ethnic racial gender religious professional or age group or endorses any form of hate or hate group; • Promotes alcohol illegal drugs tobacco firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; • Is profane or offensive; • Defames misrepresents or contains disparaging remarks about Sponsor or Administrator or their respective products or services or other people products or companies; • Contains trademarks logos or trade dress (such as distinctive packaging or phraseology) owned by any entity; • Contains copyrighted materials owned by any entity (including photographs and other works of art or images); • Contains any personal identification such as personal names street or email addresses or phone numbers other than Sponsor; • Violates or encourages the violation of any law rule or regulation;
